Terms of Service

These terms are between you and Yauheni Malashchytski ("we", "us"), the developer of New Moon: Lunar Calendar (the "app"). By downloading or using the app you accept them. If you do not accept them, do not use the app.

We grant you a personal, non exclusive, non transferable, revocable licence to use the app on Apple devices you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, reverse engineer, decompile, redistribute or sell the app or any part of it, except where that restriction is prohibited by law.

This is the most important clause on the page.

Activity guidance draws on traditional lunar-day interpretations and is offered for reflection and planning, not as medical, psychological, or financial advice.

Astronomical figures, meaning the moon phase, the illumination percentage and the lunar day, are calculated from an established model and we intend them to be accurate. The recommendations attached to each lunar day are a different thing: they come from traditional interpretation, not from science, and we make no claim that following them produces any particular outcome.

Do not use the app to decide anything about your health, your medication, your treatment, your money or your investments. Ask a qualified professional about those. Nothing in the app is a diagnosis, a prognosis or a recommendation to buy or sell anything.

Use the app lawfully. Do not use it to break any law, to interfere with its operation or our servers, to attempt unauthorised access to any system, or to submit unlawful, abusive or infringing content through the contact form or the diary.

The app is free. It offers one non-consumable in-app purchase which permanently removes the banner advert from the Today tab.

• It is a one time payment. There is no subscription, no recurring charge, no auto renewal and no free trial.
• The price is set per territory on the App Store and is shown to you before you confirm.
• Payment is taken by Apple through your Apple ID.
• It restores on other devices signed in to the same Apple ID, through Restore Purchases in Settings or on the purchase screen.
• Refunds are handled by Apple, not by us. Request one through Apple's support site. We cannot issue a refund for an App Store purchase.

Unless you buy the removal described above, the app shows one banner advert on the Today tab, served by a third party advertising network. We do not control which specific adverts appear. What the advertising involves for your data is set out in the privacy policy.

Diary reflections and check ins you write stay on your device and belong to you. We do not have them and cannot read them.

If you send us a message through the contact form, or rate a recommendation, you allow us to use that submission to answer you, to fix problems and, in the case of ratings, to produce anonymous aggregate statistics shown to other users. Ratings are not attached to your identity.

The app, its name, its icon, its interface, its written guidance and this website are ours or our licensors', and are protected by copyright and other laws. This licence gives you no rights in them beyond using the app as intended.

We may change, suspend or stop the app or any of its features at any time. We may release updates, and some may be required for the app to keep working. We do not promise the app will be uninterrupted or error free, or that it will always be available in your territory.

To the fullest extent permitted by law, the app is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non infringement.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this clause may not apply to you.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, data, goodwill or opportunity, arising from your use of or inability to use the app, including any decision you make in reliance on its guidance.

Where liability cannot be excluded, our total liability to you is limited to the greater of the amount you paid us for the app in the twelve months before the claim, or ten United States dollars.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

You agree to indemnify us against claims, losses and reasonable costs arising from your unlawful use of the app or your breach of these terms.

This licence ends if you stop using and delete the app, or if you breach these terms. The clauses on intellectual property, disclaimers, liability and governing law survive.

Required by Apple, and true:

• These terms are between you and us only, not with Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide any maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for addressing any claim relating to the app, including product liability claims, any claim that it fails to conform to a legal requirement, and claims under consumer protection or similar legislation.
• Apple is not responsible for investigating, defending, settling or discharging any third party claim that the app infringes intellectual property rights.
• You confirm that you are not located in a country subject to a United States Government embargo or designated as a terrorist supporting country, and that you are not on any United States Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third party beneficiaries of these terms and may enforce them against you.

These terms are governed by the laws of [JURISDICTION TO BE SET], without regard to conflict of law rules. Nothing here deprives you of the protection of mandatory consumer law in the country where you live, and you may bring proceedings in the courts of that country where that law gives you the right.

We may update these terms. The date at the top of this page shows when they last changed, and continuing to use the app after a change means you accept it. If a change is significant we will say so in the app's release notes.
